crash. one person suffered serious injuried. morales attorney called the crash a tragic accident. >> my condolences to the family. this is a tragedy for the two people that died and the one that was seriously hurt. >> reporter: police say morales is a known gang member but have not disclosed his criminal records. police have set bail at $10 million. a san francisco man is behind bars facing attempted murder charges. he's accused of dousing his girlfriend with gasoline then setting her on fire. police arrested 22-year-old dexter oliver at an oakland motel last night. oliver's boyfriend star lamra remained at the burn unit in st. francis hospital in critical condition. antioch police are searching for four men. police say the suspects were all in their 20s that they rushed into the shell station on loan treeway about 3:30 this morning. what they were after was beer and you can see some of the broken bodless there in the parking lot. the clerk tried to stop them and that's when the four men beat him up. police say the men didn't take

any money, they only made off with the beer. we told you yesterday here at 5:00 how the fbi is taking over the search of remains of victims of the speed killers. and today ken pritchett is live with why the fbi may be taking over that case. >> reporter: early last year shermantine threw out this map and pointed at this area. where the fbi is digging right now is not in that exact same location but they say it may not matter. it was not expected that the fbi would find anything today it could take weeks to hit bottom. it is unclear if there are any remains in this well. the victims of death row inmate wesley shermantine and the now

deceased herzog. >> this is where wesley told us in march of last year where to dig. >> reporter: leonard padilla and ron dick have been in contact with shermantine who provided them this map. >> as far as places to dig in that area, there's probably 20 to 30 wells and i bet you you can find a body down in any well. >> reporter: police believe shermantine and herzog killed dozens of people in the 90s. two women were identified. that well was about a half a mile west on flood road of the new well that the fbi began excavating yesterday morning. but on shermantine's map he pointed to a well he says contains numerous remains a well west of a small bridge. a different well from where the fbi is now digging. but both bounty hunters say it shouldn't matter. >> there was a phrase that was said they were filling up with bodies so much that they had to

keep going to different wells. so i think pretty wherever you throw a shovel you're going to be okay. >> reporter: right now you should see a live view from a chopper above the dig site where the fbi is still excavating, according to the fbi by the end of operations today when the sun goes down, they expected to have about a 10-foot deep hole there as part of their site preparations. they expect those site preparations to continue tomorrow and that the sifting out the dirt by hand, the actual investigation to begin shortly thereafter. near linden, ken pritchett. today governor jerry brown spoke publicly for the first time about his prostate cancer diagnosis and his long term outlook. >> i'm ready to go, and don't expect me to leave too soon. >> the governor said he has completed radiation treatments for what doctors say was

localized early stage prostate cancer. the 74-year-old governor underwent treatment during the holidays and both the governor and his doctors say his prognosis is good. what's being called a significant plumbing problem left an entire hospital in berkeley without water this afternoon. the code orange situation began about 1:00 this afternoon at alta base hospital. bottled water was handed out to patients and staff but some patients were calling the ktvu newsroom complaining that they didn't have water to irrigate wounds. some surgeries were also postponed. crews were seen digging outside but it's not clear what caused the problem. it is supposed to be fixed though by right about now. investigators say the petaluma teen found dead in south tahoe appears to have taken off her ski jacket and became disoriented while walking. alyssa byrne was found last friday. she had attempted to walk in

freezing weather to a hotel in state line nevada. at this point they'll try to determine if drugs or alcohol were a factor in her death. a spokesman for the oakland unified district says it will be at least a week until their district building reopened after there had been a flood there. someone accidentally left a tap on in a custodian closet overnight. the flood caused cig -- significant damage and most employees will be working from home for the rest of the week. there was a glimmer of hope this morning for a gay boy scout who's trying to earn his eagle scout rank. it's a story that has gained a

lot of attention. >> reporter: ryan andresin put up this tolerance wall. but today he found out he will not be achieving his goal and there are no appeals left. hundreds of people signed this petition asking the boys of america to allow an openly gay teen to reach the goal of eagle scout. >> this is ridiculous. >> reporter: ryan's application was -- four people on the board signed ryan's application, his family and supporters thought they had won. >> we were told last week that the council was going to approve this and send this on. >> reporter: but this morning his family found out they would not receive the votes needed.

city. that was the precursor to the gay pride parade. and her message was, parents of gay, unit in support of our children. jana katsuyama live now in pittsburg with why neighbors say they were surprised. >> reporter: there's not a lot of these incidents here in the pittsburg. take a look across the street. police are still here around the apartment. there is yellow crime tape at the area where the stabbing happened. now the police officers just told me a few minutes ago that this happened when a resident apparently heard somebody fiddling with his front door. he then looked through the peephole and saw that there was somebody outside. here's some video from the scene. police say that the resident went to get a firearm but the suspect had already gone

inside. there was a scuffle between the two. the residents gun was dropped as well as the suspect dropped a gun which was later determined to be a replica. that's when the suspect grabbed a gun and the resident stabbed the suspect in the neck and the suspect ended up dying here at the scene. neighbors tell us that they were just shocked. >> yeah i was home all day and i didn't hear anything. yeah i didn't hear anything. >> are they usually quiet over there? >> yeah, they're quiet they're quiet. every now and then you hear the kid playing around but that's about it. >> reporter: i just learned that the intruder is being identified, he is a 50-year-old pittsburg resident with an extensive criminal record. they also tell me there might be some other suspects in this attempted home invasion and so they are out there trying to work these leads. i'm going to be talking to the lieutenant as soon as we're off the air and get more information and bring it back when we're online at 7:00 for

bay area news on tv 36. for now we're reporting from pittsburg, jana katsuyama, channel 2 news. an insurance company that was bailed out by taxpayers may sue the federal government. aig paid back its $182 billion taxpayer bail out and now according to the new york times, the company's board will meet tomorrow to consider joining a $25 billion shareholder lawsuit against the u.s. government. the lawsuit claims the government's rescue deprived aig shareholders of billions of the dollars and took private property for public use without appropriate compensation. on wall street, another tough day for the markets as investors eye the first earnings report from the first quarter. the dow was down 55.5 points, the nasdaq dropped by seven and the s & p500 was down by 4.4. clinton is set to tiff --

testify in front of the committee. secretary clinton had been scheduled to testify last month but fell during an illness and suffered a concussion. she was then hospital ized for a blood clot. the 22nd is the day after the president's inauguration and is the first day the senate returns after a two daybreak. there's a possibility no american troops will remain in afghanistan after the end of combat in december 2014. the white house is considered a range of options for troop levels after 2014. that's one of them but the administration appears to favor keeping fewer than 10,000 troops there. a deputy national security advisor said the u.s. goal is not necessarily to keep troops there but to fight terrorists. afghan president karzai arrives to speak to leaders. san francisco leaders are sworn in. why two women backed away from

10:00 a.m. and shut down the airport for two hours. tom turlochson unveiled a report that emphasizes critical thinking skills over multiple choice. this new way of testing is expected to be -- to be rolled out in the 2014 and 2015 school year. rocket ship charter school has been working for years to build a new facility on a vacant lot this one here it's city owned north of the tamian light rail station. the 1-1/2 million price tag for rocket ship would pay for the land to build a public park and soccer field on near by city land but not everyone is on board with that idea. >> first of all is that the right site for that kind of

dense urban style school. and the second question is this the best deal the city can get for the use of that land. >> we have the achievement gap here between students and i think that rocket ship education will help us close that achievement gap. >> reporter: the issue goes to the sitting planning commission tomorrow. if it's approved by both panel, it then goes to the planning board of education for a zoning exemption january 23rd. a humane society worker spotted a mountain lion last night about 6:00. sheriff deputies were called out to the 800 block of portola road. but by the time they got there it appears the animal had left the area. city workers worked to fill 500 sandbags today in east palo alto. shovel full by shovel full crews loaded the sandbags. they'll be placed along san

francis creek tomorrow. the creek flooded last month during heavy rainstorms. we are just about to start peeling some pretty big changes weather wise. let's go now to our chief meteorologist bill martin. >> not a rain event but cold air event. there'll be some snow flurries on the bay area peaks. but the real impact will be the very cold air and the origins of this storm. cold storm do not bring a lot of moisture typically and this one is no exception. this system dropping over gulf of alaska and drops down here. when it comes down here there's a chance for sprinkles. i'll show you that on the computer model coming up. but we're going to look at as we enter tomorrow night thursday morning and into friday morning the overnight lows are going to be downright frosty in the 20s in some of the coldest spots. that's sort of the headline with this very, very cold air about to fill in the bay area.

50 in napa right now. it's 49 -- that's kind of chilly right. 49 in concord right now. it's chilly out there already. tonight is going to be chilly but not like thursday morning into friday morning. wednesday morning as well. temperatures will be cooler than today. these were the highs for today, 53 in concord. not really warm but warmer than they have been. temperatures now start to trend down. highs tonight in the 50s. highs as they get into the next several days. overnight lows tonight with patchy valley fog. 40 in antioch, why isn't it going to be at freezing levels tonight or just above freezing. high clouds are coming in. those high clouds kind of blanket us. those high clouds are in advance of very cold air. we get into wednesday morning, the cold air is really going to be in place without the clouds then it gets cold. so the computer model, tonight starts to fill in. those are the high clouds. they will keep us above

we've been telling you about how bad the flu season is hitting dozens of states pretty bad. it's so bad in pennsylvania a hospital has set up a tent outside the building to treat flu patients. there's six beds and the tent triage station was open for business this morning. the hospital is in near philadelphia and has seen a flood of patients and they say if this trend continues they plan to set up more tents. it was two years ago that

giffords was shot in a mass shooting in arizona. >> reporter: newtown connecticut, portland oregon, aurora, colorado, there's been more than 10 mass shootings since january 8, 2007. when a gunman opened fire in tucson arizona. >> my 6-year-old daughter was killed in a mass shooting in arizona. i have one question for lawmakers, when are you going to do something about gun violence. >> reporter: arizona senator giffords was also shot. the massacre in newtown connecticut was a decisive moment. >> how was newtown? >> it brought back a lot of memories about what that was like. so two years ago today. and you hope that this kind of thing doesn't happen again.

who was charged with getting the ship safely out to sea. and industry crews say why the bar pilot's association is hiding important information. john fowler investigated bar pilot logs and fatigue. >> reporter: that's right gasia, we learned that the bar pilot captain guy clese had 15 hours off duty before his ship ran into the bay bridge. also that in three years prior he had three quote minor incidents including being held blameless for running one ship aground. they work under unquestioned stress. fog, tides, huge ships with small margins for error. but the bar pilots association refuses to release dogs of working hours and time off. >> what is it that they have to hide? i think they have it pretty good. >> reporter: mike jacobs says the 55 men and one woman who

guide ships in and out of the bay are certainly skilled. big ships must hire them and bar pilots are indemnified for responsibility. >> we have a gps system so we have our own information. >> reporter: we learned captain clese has 1,100 trips in the bay. they work seven days on, seven off and earn $150,000 a year. >> i think people would be shocked how little they work for how much money they make and that we still have incidents and we still can't help police ourselves. >> reporter: the shipping association sued the bar pilot's commission last summer demanding release of pilot logs. the court agreed but bar pilots have now appealed telling me

late today that the data are private and personal. they also declined an on camera interview. reporting live health and science editor john fowler, ktvu news. state inspectors are looking at what led to an accident which killed an employee at a textile department. a 56-year-old man was killed when a big rig hit him while backing up to a dock. the state division of occupational safety is currently investigating that accident. the santa clara county coroner identified a woman who drowned driving into a pond on sunday as 69-year-old mayra marsh. the highway patrol says the san jose woman lost control of her car as she turned from the almond expressway toward a ramp to state highway 85. they are currently investigating why she lost control. bystanders and emergency crewed tried to get to her as soon as they could but unfortunately it

was too late. stanley arnold and nicholas gears both face felony charges in connection with the robbery of a couple in milpitas january 2nd on south main street. the robbers stole the couples wallets and cell phones at gunpoint. officers say within an hour of the heist they arrested the pair and recovered the stolen items along with a loaded gun. gut wrenching 911 calls were played today during a preliminary hearing of the man accused of killing 12 people inside a colorado movie theater. distraught relatives lined up early for today's proceedings. prosecutors are presenting evidence in their effort to bring 18-year-old james holmes to trial. today they played 911 calls where you could hear people crying for help while there was gunfire going off in the back ground. in one call you could hear 27 shots fired. despite the drama the accused gunman continued to show no reaction. >> he has no emotion. like i said before, i don't know. it's really hard to express. it's like a robot.

>> reporter: prosecutors also described the gunman's booby trapped apartment. they had a boom box set to play loud music to attract a person to the outside of his apartment. the remote was hooked up to explosive contraptions inside his apartment including improvised nay palm. the city of newtown connecticut is getting help with their bills. the state of connecticut is giving a half million dollars to businesses in the towns that have lost money because of the fall out from last month's deadly school shooting. as many as 16 businesses were essentially shut down for nearly two weeks by a crush of traffic in that normally quiet town. a study find that a small amount of drivers are responsible for large amounts

investigation. >> reporter: the rest of the nation began watching as a group of masked online activists circulated video of the graduate of a high school laughing about the rape. they helped spread a photo of the alleged victim of the rape. >> the picture of the girl from the party, the videos, that you refer to and that have already been made public. that may be something that hurts the victim more. that may be painful for her family. any regrets that bringing so much attention to this causes a backfire, a backlash against the victim. >> normally i would agree with you. but we've been in contact with the victim through her best friend who is constantly with her. we prefer like a third party contact with her. she felt it was being swept under the rug as well and justice was not going to be served. >> reporter: a petition to get
